This comment suggests pinning to <3.12 is due to configspace compatibility, but configspace supports 3.12 explicitly.. https://github.com/automl/ConfigSpace/blob/main/pyproject.toml#L44

It might be worth noting that I submitted a draft PR to the TPOT2 repo that might contribute toward addressing this and other dependency management issues. It's likely not the final solution yet, but hopefully a useful start.
